Geoffrey M. Gilbert, Jr. practices in all areas of labor and employment law with an emphasis in litigation before the federal courts and the National Labor Relations Board. In representing and serving the firm’s clientele, Geoff relies upon his legal education, where he concentrated his studies in the area of employment law and received a Certificate in Employment Law as well as his close to ten (10) years of experience in private practice.
In the arena of traditional labor Geoff provides multiple services, which include union avoidance, proceedings before the NLRB, including NLRB unfair labor practices, statutory remedial issues, and NLRB representation proceedings, inclusive of post-election challenge and objection proceedings. With respect to established bargaining relationships, Geoff has experience negotiating collective bargaining agreements and providing legal advice regarding strikes. Geoff also has experience representing management in Arbitration proceedings, having dealt with a multitude of disciplinary and contract interpretation issues, as well as pre- and post-arbitration litigation and duty of fair representation litigation.
Geoff also handles all facets of employment law, including employment discrimination claims arising under Title VII, the Civil Rights Act of 1991, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, and the Family and Medical Leave Act. Geoff provides advice for and/or participates in ongoing internal corporate investigations, and investigates, responds on behalf of and defends management from employee discrimination claims filed with federal and/or state administrative agencies. In performing these services he has appeared and litigated cases in federal and state courts and before administrative agencies throughout the country. In addition, Geoff advises clients on employment-related matters such as personnel policies, daily human resources issues, employment contracts, and employee handbooks.
