The NLRB Files Complaint Against Wal-Mart For Allegedly Harassing, Threatening, and Terminating Employees

On January 15, 2014, the National Labor Relations Board (“NLRB” or “the Board”) filed a complaint against Walmart alleging the employer violated the National Labor Relations Act by harassing, threatening, and later terminating employees who participated in a series of protests and strikes against the company. Specifically, the NLRB’s complaint alleges that in statements to employees at Walmart stores in California and Texas, Walmart unlawfully threatened employees with reprisal if they engaged in strikes and protests on November 22, 2012. It also alleges that Walmart stores in California, Colorado, Florida, Illinois, Kentucky, Louisiana, Maryland, Massachusetts, Minnesota, North Carolina, Ohio, Texas and Washington unlawfully threatened, disciplined, and/or terminated employees for having engaged in legally protected strikes and protests.

Moreover, according to the Board’s complaint, Walmart illegally terminated and issued other disciplinary action to over 70 workers in June of 2013, after hundreds of employees went on strike and protested against the employer’s pay, benefits, work schedules and part-time jobs. A hearing regarding these allegations has not been scheduled yet, however, if found liable, Walmart would likely be ordered to reinstate the terminated workers, pay back-pay wages, and required to inform and educate all employees of their legally protected rights.
