Today, the Missouri Supreme Court issued its opinion on challenges to Proposition A. On December 6, 2024, business groups filed a lawsuit seeking to overturn the law arguing that it should be set aside for (1) having a misleading summary statement and fiscal note summary for Proposition A; and (2) violated Missouri’s requirement that legislation have a “single subject” and “clear title.” The Missouri Supreme Court held that there was no “election irregularity” resulting from the misleading summary statement or fiscal note. However, it determined that it lacked jurisdiction to decide whether Prop A violated the “single subject” and “clear title” requirements of Missouri’s Constitution. It is therefore possible that these arguments could be raised again in a lower court.
Republicans in the Missouri Legislature are continuing efforts to repeal or reduce the impact of Proposition A on Missouri business. The legislative session closes on May 16, 2025. We will continue to provide updates on this important issue as they become available.
